Several news outlets are reporting that an amendment to Spanish law has been approved which will enable fast-track trials and “express evictions” to address squatting issues more efficiently. The reform modifies the Criminal Procedure Code, expediting the legal processes for squatter related offences. Key changes include :
1. Shortened Timeline: Courts must summon alleged squatters within 72 hours after their arrest, with trials scheduled within 15 days and judgements delivered within three days. This is a significant improvement compared to the previous system, which often took months or even years to resolve cases.
2. Focus on Criminal Cases: The reform applies to cases of criminal squatting, such as illegal entry or breaking and entering. Civil cases, like disputes over expired rental contracts, remain under slower civil procedures.
3. Immediate Evictions: The new process eliminates some bureaucratic steps, ensuring quicker property recovery for landlords.
The reform still requires final approval from the Senate, but it’s passage is highly likely due to the support from the majority party.
